 1. DCA Issues “Endorsements Know-Hows!” Guidelines to Hold Celebrities, Influencers, And Virtual Influencers on Social Media Platforms Accountable

The Department of Consumer Affairs (DCA), operating under the Ministry of Consumer Affairs, Food and Public Distribution (MoCA, F&PD), has recently published a collection of principles called "Endorsements Know-Hows!" which outlines best practices for celebrities, influencers, and virtual influencers on social media platforms.

Important Guidelines :

(i) The newly released guidelines emphasize that endorsements must be communicated in plain, uncomplicated language. To describe a paid or bartered brand endorsement, terms such as “advertisement,” “sponsored,” “collaboration,” or “paid promotion” may be used, as long as the individual has personally used or researched the product or service.

(ii) To avoid confusion about which disclosure word to use for different kinds of partnerships, the DCA has issued guidelines on the use of terms like “advertisement,” “ad,” “sponsored,” “collaboration,” or “partnership.” If used, these terms must be expressed as a hashtag or in the headline text.

(iii) The guidelines highlight the importance of disclosing endorsements made by individuals or groups who have the ability to influence their audience's decisions to purchase or form opinions about a product, brand, service, or experience.

(iv) According to the guidelines, disclosures must be prominent, clear, and unambiguous, and should not be mixed in with other hashtags or links. For endorsements made through pictures, the disclosure must be superimposed over the image. For videos or live streams, disclosures must be made both in audio and video formats, and presented continuously and prominently throughout the entire stream.

(v) In summary, the guidelines require that endorsements be expressed clearly, that disclosures be made in a prominent and unambiguous manner, and that influencers or celebrities disclose their relationship to the brand or product they are endorsing. These guidelines are meant to prevent consumer confusion and ensure transparency in social media advertising.
